1. About this policy
This policy explains how Spotlessway - Professional Cleaning & Security Services (ABN 36 689 321 667, ACN 654 391 429) of Sunshine West, Victoria (“we”, “us”, “our”) collects, holds, uses and discloses personal information. In this policy, “personal information” has the meaning given to it in the Privacy Act 1988 (Cth).
It applies to information collected through spotlessway.com.au and to information we handle in the course of providing commercial cleaning and security services.
We handle personal information in accordance with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth). Where that Act does not strictly apply to us, we apply these standards as a matter of policy.
By using this website or submitting an enquiry, you agree to this policy. If you do not agree, please do not use the website or send us your information. This policy should be read with our Terms & Conditions.
2. Information we collect
2.1 Through this website. Our quote form and quick-enquiry widget collect only what you choose to enter:
- your name and business name;
- your phone number and email address;
- the site address or suburb the enquiry relates to;
- the service and frequency you are interested in; and
- any further details you include in the message field.
2.2 When you contact us directly. If you telephone or email us, we collect the information you provide in that communication.
2.3 In the course of providing services. Where you engage us, we may also collect site contact names and numbers, access and security arrangements for the premises, service schedules and completion records, and correspondence relating to the engagement. Where we provide security services, this may extend to patrol, attendance and incident records.
2.4 Technical information. Our hosting provider automatically records standard server log information, which may include IP addresses, browser type and the date and time of requests. We use this only for security and to keep the website operating.
2.5 What we do not collect. We do not collect payment card details through this website. We do not use advertising or analytics cookies, and this website sets no tracking cookies of any kind. We do not knowingly collect sensitive information as defined in the Privacy Act 1988 (Cth) unless it is reasonably necessary for our services and you consent to us doing so.
2.6 Unsolicited information. If we receive personal information we did not ask for and could not lawfully have collected, we will destroy or de-identify it where it is lawful and reasonable to do so.
3. Why we use your information
We use personal information to respond to your enquiry, prepare and provide a quote, arrange a site walk-through, deliver and administer our services, maintain our business and accounting records, and meet our legal obligations.
We will not use or disclose personal information for a purpose unrelated to the purpose for which it was collected unless you would reasonably expect it, you consent, or the use or disclosure is required or authorised by law.
4. Cookies and browser storage
This website sets no cookies. Our quick-enquiry widget stores a single value in your
browser’s local storage (sw_quote_widget) so that it does not reopen
repeatedly during a visit. That value stays on your device, is not transmitted to us, and can
be cleared at any time through your browser settings.
This website loads fonts from Google Fonts. That request is made by your browser directly to Google’s servers and discloses your IP address to Google, which handles it under its own privacy policy. We receive no information from it.
5. Disclosure to others
5.1 Service providers. We disclose personal information to providers who help us run the website and receive enquiries, namely our website host (Vercel) and our transactional email provider (Resend). They process the information only to provide those services to us.
5.2 Subcontractors. We perform services through our own personnel and, where applicable, through approved independent subcontractors. Where a subcontractor attends your site, we disclose only the personal information they need to perform the work — typically the site address, access and security arrangements, and a site contact name and number. We require subcontractors to keep that information confidential, to use it only for performing the services, and to meet our screening requirements. Our Terms & Conditions set out the insurance and licensing we require of them.
5.3 Others. We may also disclose personal information to our professional advisers and insurers, and where disclosure is required or authorised by law, by a court or tribunal, or by a government or regulatory authority.
5.4 We do not sell personal information, and we do not disclose it to third parties for their own marketing purposes.
6. Overseas disclosure
The providers referred to in clause 5.1 store and process information on servers that may be located outside Australia, principally in the United States and the European Union.
By submitting an enquiry through this website you consent to your personal information being disclosed to those overseas recipients. You acknowledge that, where you give that consent, Australian Privacy Principle 8.1 does not require us to take steps to ensure that an overseas recipient handles your information in accordance with the APPs, and that we will not be accountable under section 16C of the Privacy Act 1988 (Cth) for that recipient’s handling of it. Overseas recipients may not be subject to privacy laws equivalent to Australia’s, and you may not be able to seek redress under Australian law.
If you would prefer not to consent to an overseas disclosure, please telephone us on 0433 043 969 instead of using the form.
7. Direct marketing
We do not add website enquiries to marketing lists. If we ever send you commercial electronic messages, we will do so consistently with the Spam Act 2003 (Cth) and will include a functional unsubscribe facility. You may ask us at any time not to contact you for marketing purposes, and we will action that request.
8. Security of your information
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include serving this website over an encrypted connection (HTTPS), restricting access to enquiry records to personnel who need it, and not storing payment card details.
However, no method of transmission over the internet and no method of electronic storage is completely secure. While we take reasonable steps, we cannot guarantee the security of information transmitted to us, and any transmission is at your own risk. To the maximum extent permitted by law, we are not liable for any unauthorised access to, or loss, misuse or alteration of, personal information that occurs despite our having taken reasonable steps.
9. Data breaches
If we suspect a data breach involving personal information we hold, we will assess it and, if it is an eligible data breach likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required by Part IIIC of the Privacy Act 1988 (Cth).
10. How long we keep it
We retain personal information for as long as it is needed for the purpose it was collected and, where you become a client, for the life of the engagement plus any period required by Australian taxation and record-keeping laws, which is generally up to seven years. Enquiries that do not proceed are destroyed or de-identified once they are no longer required.
11. Access, correction and complaints
11.1 Access and correction. You may request access to the personal information we hold about you, or ask us to correct it, by contacting us using the details in clause 16. We will respond within a reasonable period, ordinarily 30 days. We may need to verify your identity first. We do not charge for making a request, although we may charge a reasonable fee for the cost of giving access. If we refuse access or correction, we will tell you why in writing and how you may complain, except where it would be unreasonable to do so.
11.2 Complaints. If you believe we have breached the APPs, please complain to us in writing using the details in clause 16. We will acknowledge your complaint and respond within 30 days. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
12. Children
Our services are directed to businesses and organisations. This website is not intended for children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with personal information, please contact us and we will take reasonable steps to delete it.
13. Third-party links
This website may contain links to third-party websites. Those websites are not under our control. We are not responsible for their content, their accuracy or their privacy practices, and the inclusion of a link is not an endorsement. You should read the privacy policy of any website you visit.
14. Website content and liability
14.1 General information only. The content of this website, including any guidance on cleaning practices, frequencies or costs, is general information provided in good faith. It is not advice, it does not take account of your particular circumstances, and it does not constitute an offer or a quotation. Prices and scope are confirmed only in a written quotation issued by us following a site inspection.
14.2 No warranty. To the maximum extent permitted by law, we make no representation and give no warranty that the content of this website is accurate, complete, current or free from error, or that the website will be available uninterrupted or free of viruses or other harmful components.
14.3 Limitation of liability. To the maximum extent permitted by law, we exclude all liability for any loss or damage (including indirect, special or consequential loss, loss of profit, loss of revenue, loss of data or loss of business opportunity) arising out of or in connection with your use of, or reliance on, this website or its content, however that liability arises, including in negligence.
14.4 Your rights are preserved. Nothing in this policy excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law which cannot lawfully be excluded, restricted or modified. Where our liability may be limited but not excluded, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
15. Changes to this policy
We may update this policy from time to time to reflect changes in our practices or in the law. The current version is the one published on this page and is identified by the revision date at the top. Your continued use of the website after a change is published constitutes acceptance of the updated policy.
16. Governing law and contact
This policy is governed by the laws of the State of Victoria and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.
